Who Is a Court-Appointed Expert?
Act No. 36/1976 Coll., on Experts and Interpreters, dated April 6, 1976 (effective as of July 1, 1976), defines a court-appointed expert as a person entered in the official Register of Experts and Interpreters. Experts are appointed by the Minister of Justice or the President of a Regional Court.
A person may be appointed as an expert if they:
– are a citizen of the Czech Republic, a citizen of another EU member state with a residence permit in the Czech Republic, or a foreign national with permanent residence in the Czech Republic,
– have full legal capacity,
– are of good character (have not been convicted of an intentional or negligent crime related to expert activities),
– have not been removed from the list of experts within the past three years for violation of statutory duties,
– possess the necessary expertise and experience in their field, including completion of specialized training if required for that discipline,
– have the personal qualities necessary to perform expert duties properly,
– and consent to the appointment.
The court-appointed expert must take an oath before the appointing authority:
“I solemnly swear that I will strictly comply with the law, that I will carry out my expert duties impartially and to the best of my knowledge, fully apply my expertise, and maintain confidentiality regarding all information obtained during the performance of my duties.”
Proposals for appointment may be submitted by public authorities, scientific institutions, universities, or organizations employing potential experts, as well as civic associations or foundations related to the relevant field. An individual may also apply for appointment independently.
When Do You Need a Court-Appointed Expert Report?
You will typically need a report prepared by a court-appointed expert for tax purposes (such as real estate acquisition or gift tax), inheritance proceedings, or to determine the replacement cost for accounting purposes.
